5. Calling, Consent, and Regulatory Compliance
You are responsible for determining the laws, rules, consent requirements, calling-hour restrictions, disclosure requirements, opt-out obligations, suppression requirements, election laws, fundraising rules, and other requirements that apply to each campaign.
Press 1 Voice may provide workflow, caller identity, authentication, reporting, or number-health tools, but those tools do not constitute legal advice and do not guarantee that a campaign is compliant.
You control your audience, contact lists, message content, campaign purpose, timing, caller identity choices, consent basis, and follow-up process. You remain responsible for ensuring those decisions are lawful.
6. Customer Data and Campaign Content
“Customer Data” includes contact information, campaign lists, message content, audio files, scripts, response data, campaign settings, and other information that you or your authorized users submit to or process through Press 1 Voice.
You retain your rights in Customer Data. You grant Press 1 Voice the rights reasonably necessary to host, process, transmit, display, and otherwise use Customer Data to provide, maintain, secure, and support the services.
You represent that you have the rights and permissions necessary to provide Customer Data to Press 1 Voice and to use it for your intended campaigns.
7. Third-Party Services and Integrations
Press 1 Voice may interoperate with CRMs, campaign systems, voter or member databases, APIs, webhooks, telecom providers, and other third-party services. Your use of third-party services is governed by the terms and privacy practices of those providers.
Press 1 Voice is not responsible for third-party systems, outages, changes, data practices, access restrictions, or decisions made by carriers or external reputation providers.
See the Integrations page for general information about supported integration workflows.
8. Fees, Usage, Billing, and Taxes
Fees may include platform charges, usage-based calling charges, feature charges, setup fees, integration fees, support fees, taxes, or other amounts described in your order form, pricing page, invoice, or service agreement.
You are responsible for charges incurred through your account. Pricing, billing frequency, included usage, overages, credits, renewal terms, cancellation rights, and refund eligibility are governed by the commercial terms presented to you at purchase or in a separate agreement.
For current public pricing information, see Pricing.
9. Intellectual Property
Press 1 Voice and its licensors retain all rights in the website, software, platform, designs, documentation, branding, trademarks, service marks, technology, and other materials provided as part of the services, excluding Customer Data.
Subject to these Terms and any applicable subscription or service agreement, you receive a limited, non-exclusive, non-transferable right to use the services for your internal authorized purposes.
10. Suspension and Termination
Press 1 Voice may restrict, suspend, or terminate access when reasonably necessary to protect the platform, users, carriers, recipients, third parties, or the integrity of the service, including where there is suspected unlawful use, abuse, security risk, non-payment, or material breach of these Terms.
Termination does not eliminate payment obligations or other provisions that by their nature should survive termination.
11. Service Disclaimers
To the maximum extent permitted by law, the services are provided on an “as available” basis. Press 1 Voice does not guarantee uninterrupted availability, delivery to every recipient, specific answer rates, conversion rates, fundraising results, election outcomes, carrier treatment, caller reputation, or removal of spam labels.
Caller authentication technologies such as STIR/SHAKEN do not guarantee call completion, answer rates, or legal compliance.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Press 1 Voice will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost opportunities, loss of goodwill, or loss of data arising from or related to your use of the services.
Any additional limitation of liability, liability cap, or allocation of risk contained in an applicable order form or negotiated service agreement will control if it conflicts with this section.
13. Indemnification
To the extent permitted by law and any applicable agreement, you agree to be responsible for claims, losses, liabilities, or expenses arising from your unlawful use of the services, your campaign content, your contact lists, your violation of these Terms, or your violation of third-party rights.
14. Governing Terms and Disputes
If you have an order form, master service agreement, or other written agreement with Press 1 Voice, that agreement may include governing law, venue, dispute-resolution, arbitration, or other legal terms that supplement or replace this section.
If no separate written agreement applies, the governing law and dispute-resolution framework applicable to your relationship with Press 1 Voice should be confirmed in the final legal terms published by the business.
If your organization has a signed order form, master service agreement, or other written contract with Press 1 Voice, the governing law and dispute terms in that agreement will apply to the extent stated there.
15. Changes to These Terms
Press 1 Voice may update these Terms from time to time. The “Last updated” date will indicate when the current version became effective. Where required by law or contract, additional notice may be provided.
Your continued use of the services after updated Terms become effective may constitute acceptance of the revised Terms where permitted by law.
